フィリピン人との結婚手続き|栃木で必要な書類と順番

日本人とフィリピン人が結婚して、日本で一緒に暮らすまでには、三つの国の役所を、決まった順番で通ります。書類そのものは難しくありません。難しいのは順番です。ここを間違えると、取り直しになる書類が出ます。栃木に住んでいる方が、どこへ、何を、どの順で出すのかを一本にまとめました。

すでに日本で暮らしているフィリピン人の方と、日本で結婚する場合(日本方式)を前提にします。栃木にお住まいであれば、ほとんどがこの形になります。

3で日本の手続きは終わりますが、4を出さないとフィリピン側では独身のままです。ここを放置したまま何年も経ってしまう方が、実際にとても多い。詳しくは後半で説明します。

いちばん大事なのは、順番の原則ひとつだけ

時間がかかるものから着手し、有効期限があるものは後から取る。

この手続きに出てくる書類は、「取るのに時間がかかるが期限のないもの」と、「すぐ取れるが期限が短いもの」の二種類に分かれます。順番を逆にすると、後半の手続きに入る前に前半の書類が切れます。

最初に確認してほしいこと

フィリピン人の方に離婚歴がある場合、この記事の順番には入れません。フィリピンには離婚制度がないため、日本で離婚が成立していても、フィリピン側の記録は婚姻したままです。その状態ではCENOMARが出ず、LCCMも出ません。

先にフィリピンの裁判所で外国離婚の承認(Judicial Recognition of Foreign Divorce)を得る必要があります。ここだけで年単位かかることがあるため、いちばん最初に着手してください。日本で離婚したのに、フィリピンでは結婚したままになっている に流れをまとめています。

ステップ1|フィリピン側の書類を揃え、アポスティーユを受ける

必要なのは PSA発行の出生証明書CENOMAR(婚姻記録不存在証明書)の2点です。どちらもフィリピン統計庁(PSA)が発行します。日本にいながら取り寄せられます。

そのうえで、両方にフィリピン外務省(DFA)のアポスティーユ認証を受けます。大使館が受け付けるのは認証済みのものだけなので、ここを飛ばすと窓口で止まります。PSAで取る手続きと、DFAで認証を受ける手続きは別だと覚えておいてください。

CENOMARを取るタイミング

CENOMARは発行から6ヶ月でLCCMには使えなくなります。早く取りすぎると、アポスティーユと大使館の処理を待っているうちに切れます。アポスティーユまで含めて2ヶ月ほど見込み、大使館に行く目処が立ってから取るのが安全です。

ステップ2|大使館でLCCMを取る

LCCM(Legal Capacity to Contract Marriage)は、フィリピン政府が「この人は結婚できる状態です」と証明する書類です。日本の市役所が婚姻届を受理するために必要になります。

栃木県は在東京フィリピン共和国大使館の管轄です。大使館が公表している管轄区域は、秋田・青森・千葉・福島・群馬・北海道・茨城・岩手・神奈川・宮城・沖縄・埼玉・栃木・東京・山形。名古屋総領事館や大阪総領事館ではなく、六本木の大使館が窓口になります。

18歳から25歳の方は、親の書類が要ります

フィリピン人の方の年齢によって、追加書類があります。これは日本側にはない要件なので、見落とされがちです。

  • 18〜20歳:Affidavit of Parental Consent(親の同意書)
  • 21〜25歳:Affidavit of Parental Advice(親の助言書)
  • 26歳以上:不要

いずれもフィリピンの公証人による認証と、外務省の証明が必要です。ご両親がフィリピンにいる場合、ここでも往復の時間がかかります。

通常処理は書類が揃ってから10営業日、特急で5営業日です。2週間程度は見ておいてください。

郵送でも申請できます

LCCMの申請は予約して窓口に行く方法のほかに、郵送で申請する方法があります。宇都宮から六本木までは片道2時間近くかかるので、郵送は現実的な選択肢です。

ただし、どちらかが窓口に出頭できない場合は、申請書に日本の公証人の認証を受ける必要があります。公証役場での手続きが一件増えることになるため、時間と費用を比べて選んでください。栃木県内の公証役場は、宇都宮公証センター(宇都宮市大通り)、小山公証役場、足利公証役場、大田原公証役場の4か所です。

ステップ3|栃木の市役所・町役場に婚姻届を出す

LCCMが出たら、市区町村の窓口で婚姻届を出します。栃木県内は14市11町、どこの窓口でも構いませんが、本籍地以外に出すと戸籍への反映に日数がかかります。急いでいる場合は日本人側の本籍地に出すほうが早く終わります。

  • 戸籍謄本(日本人側。本籍地に出す場合は不要なことが多い)

訳文について

訳文に資格は要りません。翻訳者の氏名と日付を記載すれば、ご本人やご家族が作ったものでも受理されるのが原則です。ただし、人名の綴り・生年月日・地名を原本と一字一句そろえてください。ここがずれると、後の入管の審査で「同一人物か」を確認され、追加資料を求められる原因になります。

市区町村によって、求める訳文の様式や部数の運用が違います。出す前に窓口に電話で一度確認するのが確実です。「フィリピン人と結婚するので、LCCMと出生証明書を持っていきます」と伝えれば、必要なものを教えてくれます。

受理されたあと

その場で婚姻届受理証明書を発行してもらえます。戸籍謄本に婚姻の事実が載るまでは、本籍地に出した場合で数日、それ以外だと1〜2週間ほどかかります。入管の申請には婚姻の記載がある戸籍謄本が必要なので、受理証明書だけで先に進もうとせず、戸籍に載るのを待ってください。

ステップ4|大使館にReport of Marriageを出す

日本で婚姻届が受理されても、フィリピン政府はそれを知りません。Report of Marriage(ROM/婚姻報告)を大使館に出して、はじめてフィリピン側の記録に登録されます。

出さないと、フィリピンでは独身のままです。

放置すると、次のようなところで詰まります。

  • フィリピンのパスポートを結婚後の姓に変更できない
  • お子さんが生まれたときの出生報告(Report of Birth)が受け付けられない
  • 将来、フィリピンにある不動産の相続や名義変更で配偶者と認められない
  • PSAの記録上は独身のままなので、CENOMARを取ると「未婚」と出てしまう

期限は1年です

婚姻の日から1年以内に提出します。過ぎた場合でも受け付けてもらえますが、Affidavit of Delayed Registration(遅延登録の宣誓供述書)を大使館で作成する必要が生じます。手間が増えるだけなので、婚姻届が受理されたらすぐに準備を始めてください。

4部ずつという点に注意してください。ここでコピーが足りずに出直しになる方が多いところです。ROMも郵送で提出できます。

ステップ5|宇都宮の入管に配偶者ビザを申請する

ここからが、この手続きでいちばん審査の重い部分です。在留資格「日本人の配偶者等」の申請には、入り口が二つあります。

アクセスは、JR宇都宮駅西口から関東自動車バスまたはJRバス関東で「裁判所前」下車、徒歩2分。東武宇都宮駅からは徒歩10分です。

管轄は栃木県・茨城県・群馬県。なお、栃木県は水戸出張所(茨城県水戸市北見町1-1)と高崎出張所(群馬県高崎市高松町26-5)の分担区域にも入っています。県南にお住まいで高崎のほうが近い、混雑を避けたい、といった場合はそちらでも申請できます。

入管が公表しているとおり、日本で発行される証明書はすべて発行日から3ヶ月以内のものを出します。外国語の書類には日本語の訳文を添えてください。

審査の見方について

この申請で入管が見ているのは、大きく二つです。生活の経済的な安定と、婚姻が実体を伴っているか。前者は課税証明・納税証明・預貯金で、後者は質問書・スナップ写真・交流の記録で判断されます。

足りない書類があると審査が大幅に遅れ、場合によっては不利な処分につながると入管自身が注意しています。「出せるものは最初に全部出す」が、結果的にいちばん早く終わります。

2026年6月14日からの変更(お子さんがいる場合)

在留カードの様式が変わり、2026年6月14日以降に交付される在留カードからは、1歳以上の方について顔写真の提出が必要になりました。それ以前は16歳未満は写真が不要でしたが、1歳以上16歳未満のお子さんも写真が要ります

お連れのお子さんと一緒に呼び寄せる場合、以前の情報をもとに準備すると写真が足りません。古い解説記事が多く残っているので注意してください。

フィリピンで先に結婚する場合(フィリピン方式)

順番を逆にして、フィリピンで先に挙式・婚姻登録をする方法もあります。現地でご家族と式を挙げたい場合はこちらになります。

この場合、日本人側が在フィリピン日本国大使館で婚姻要件具備証明書を取り、現地の市町村役場で婚姻許可証(Marriage License)を取得して婚姻します。成立後、3ヶ月以内に日本の本籍地の市区町村へ報告的届出をします(戸籍法41条)。

栃木にお住まいで日本での生活を予定しているなら、日本方式のほうが手続きは短くて済みます。フィリピン方式は現地滞在が必要で、書類の往復も増えます。式は結婚後に改めて挙げることもできるので、順番を分けて考えると負担が軽くなります。

栃木から動く場合の、現実的な段取り

ここまでを地図の上に置くと、栃木にお住まいの方が実際に足を運ぶ先は二か所だけです。

  • 東京・六本木の大使館(LCCMとROM)— 宇都宮から片道2時間前後。予約制なので、行く日は一日空けてください。郵送申請にすれば、この往復はゼロにできます
  • 宇都宮・小幡の入管(配偶者ビザ)— 受付は16時まで。混雑する時期は午前中に行くのが無難です

大使館は、各県で領事出張サービス(Outreach Mission)を不定期に開催しています。栃木でも2024年9月に実施されました。開催されれば県内で申請できるので、急がない場合は大使館サイトの告知を見ておく価値があります。

つまずきやすいところ

起きること原因と対処
CENOMARが出ず、AOMが届いたPSAに婚姻記録があります。離婚歴がある場合は、先にフィリピンでの承認裁判が必要です。こちら

Japan is finished at step 3. But until you file step 4, the Philippines still has you down as single. A great many people leave it for years. More on why that hurts you below.

There is really only one rule to remember

Start the slow things first. Collect the things that expire last.

Every document here is one of two kinds: slow to obtain but never expires, or quick to obtain but expires fast. Do them in the wrong order and the early papers die before the later steps can use them.

Read this before anything else

If you have been divorced, you cannot start at step 1. The Philippines has no divorce, so even a divorce finalised in Japan leaves your Philippine record showing you as married. No CENOMAR will be issued, and therefore no LCCM.

You first need a Philippine court to grant Judicial Recognition of Foreign Divorce. That alone can take a year or more, so it has to be the very first thing you begin. The route is set out in You are divorced in Japan. The Philippines still has you married.

Step 1 — Get your Philippine documents, then get them apostilled

You need two: your PSA birth certificate and your CENOMAR (Certificate of No Marriage Record). Both are issued by the Philippine Statistics Authority, and both can be ordered without leaving Japan.

Both then need an apostille from the Philippine Department of Foreign Affairs. The Embassy will only accept apostilled copies, so skipping this means being turned away at the counter. Obtaining a document from the PSA and having it apostilled by the DFA are two separate procedures.

When to order your CENOMAR

A CENOMAR is only good for 6 months at the Embassy. Order it too early and it expires while you are waiting on the apostille and the Embassy's own processing. Allow roughly two months for the apostille, and order the CENOMAR once you can see your Embassy date.

Step 2 — Get your LCCM at the Embassy

The LCCM is the Philippine government certifying that you are legally free to marry. A Japanese city hall needs it before it will accept your marriage registration.

Tochigi falls under the Philippine Embassy in Tokyo. The Embassy's published jurisdiction is Akita, Aomori, Chiba, Fukushima, Gunma, Hokkaido, Ibaraki, Iwate, Kanagawa, Miyagi, Okinawa, Saitama, Tochigi, Tokyo and Yamagata. Not Nagoya, not Osaka — Roppongi.

This requirement has no equivalent on the Japanese side, which is exactly why it gets missed.

Both must be notarised by a Philippine notary public and certified by the Department of Foreign Affairs. If your parents are in the Philippines, build in time for documents to travel.

Regular processing is 10 working days from the receipt of complete documents; express is five. Plan on about two weeks.

You can apply by post

The LCCM can be filed either in person by appointment or by mail. Roppongi is close to two hours each way from Utsunomiya, so posting it is a genuine option.

The catch: if either of you cannot appear in person, your forms must be notarised by a Japanese notary public — one more appointment, at a notary office. Tochigi has four: the Utsunomiya Notary Centre, and notary offices in Oyama, Ashikaga and Otawara. Weigh that against the train fare and a day off work.

Step 3 — File the marriage registration at your city or town hall

Once the LCCM is issued, you file the kon-in todoke at a municipal office. Tochigi has 14 cities and 11 towns and any of them will accept it — but filing somewhere other than the Japanese spouse's registered domicile means the family registry takes longer to update. If you are in a hurry, file at their honseki.

  • Your PSA birth certificate, with a Japanese translation
  • Your passport
  • The Japanese spouse's family registry (often unnecessary if filing at their honseki)

About the translations

No qualification is required. As a rule a translation prepared by you or a family member is accepted, provided it carries the translator's name and the date. But the spelling of names, the dates and the place names must match the original exactly, character for character. A mismatch here is what later makes Immigration ask whether these documents describe the same person, and ask you for more.

Municipalities differ on the format and the number of copies they want. Call the counter once before you go. Tell them you are marrying a Filipino national and will bring an LCCM and a PSA birth certificate, and they will tell you what they need.

After it is accepted

Ask for the certificate of acceptance (juri shomeisho) on the spot. The marriage appears on the family registry within a few days if you filed at the honseki, otherwise one to two weeks. Immigration needs a family registry that actually shows the marriage — don't try to move ahead on the acceptance certificate alone.

Step 4 — File the Report of Marriage with the Embassy

Japan accepting your marriage tells the Philippines nothing. The marriage only reaches your Philippine civil record when you file a Report of Marriage (ROM) at the Embassy.

Until you do, the Philippines still has you single.

What that blocks, later:

  • You cannot change your Philippine passport to your married name
  • If you have a child, the Report of Birth cannot be accepted
  • In any future inheritance or transfer of property in the Philippines, your spouse is not recognised
  • Your PSA record still says single, so a CENOMAR would still come back showing no marriage

The deadline is one year

File within one year of the marriage. Later filings are still accepted, but you will have to execute an Affidavit of Delayed Registration at the Embassy. It is pure extra work — start preparing as soon as the city hall accepts your registration.

Note the four copies of everything. Running short on photocopies is the single most common reason people are sent home. The ROM can also be filed by mail.

Step 5 — Apply for the spouse visa at Utsunomiya Immigration

This is the part that is actually examined. There are two doors into the status of residence Spouse or Child of a Japanese National.

From JR Utsunomiya Station west exit, take a Kanto Bus or JR Bus Kanto to Saibansho-mae, then 2 minutes on foot. From Tobu Utsunomiya Station it is a 10-minute walk.

Its jurisdiction is Tochigi, Ibaraki and Gunma. Note that Tochigi is also within the shared area of the Mito branch (1-1 Kitami-cho, Mito, Ibaraki) and the Takasaki branch (26-5 Takamatsu-cho, Takasaki, Gunma). If you live in southern Tochigi, or want to avoid a busy day, you may file at either.

As Immigration publishes it: every certificate issued in Japan must be less than 3 months old, and any document in a foreign language must have a Japanese translation attached.

What the examiner is actually looking for

Two things. Whether the household is financially stable, and whether the marriage is real. The first is read from the tax certificates and savings; the second from the questionnaire, the snapshots and your record of contact.

Immigration warns in its own words that an incomplete filing can delay the examination substantially, and may lead to an adverse decision. Submitting everything you have at the outset is, in practice, the fastest route.

Changed on 14 June 2026 — relevant if you have children

The residence card was redesigned. For cards issued on or after 14 June 2026, a photograph is required for everyone aged 1 and over. Previously no photo was needed under 16 — now children between 1 and 15 need one too.

If you are bringing a child with you and you prepare from an older guide, you will arrive a photo short. A great many articles online still describe the old rule.

If you marry in the Philippines first

You can reverse the order and hold the wedding and the registration at home. This is the route if you want the ceremony there with your family.

The Japanese partner obtains a certificate of legal capacity from the Japanese Embassy in Manila, you obtain a Marriage License from the local civil registrar, and you marry. Afterwards, the marriage must be reported to the Japanese municipality within 3 months (Family Register Act, Article 41).

If you live in Tochigi and intend to live in Japan, the Japanese-first route is shorter. The Philippine route needs time on the ground there and more documents crossing the ocean. You can always hold the ceremony afterwards — separating the wedding from the paperwork makes both easier.

What this looks like as a journey, from Tochigi

Put on a map, there are only two places you physically go.

  • The Embassy in Roppongi, Tokyo — for the LCCM and the ROM. Around two hours each way from Utsunomiya, and by appointment, so set aside the whole day. Filing by post removes this trip entirely.
  • Immigration in Obata, Utsunomiya — for the visa. The counter closes at 16:00; in busy seasons, go in the morning.

The Embassy also runs consular outreach missions in the prefectures from time to time — Tochigi last had one in September 2024. When one is held you can file locally, so if you are not in a rush it is worth watching the Embassy's announcements.

日本の役所で離婚届が受理され、戸籍には「独身」と書かれている。それなのにフィリピンから届いた書類には、まだ婚姻の記録が残っている——この状態は珍しいことではありません。制度上そうなるからです。ここでは、なぜそうなるのか、日本で再婚の届出が受理された場合はどうなるのか、そして元に戻すために何が必要かを、順を追って説明します。

まず、何が起きているのか

フィリピンは、バチカン市国を除けば、世界で唯一離婚が法律で認められていない国です。2024年5月に離婚を合法化する法案が下院を通過しましたが、2026年8月現在、上院での成立には至っていません。

そのため、日本の役所で離婚が成立しても、フィリピン側の記録は何も変わりません。日本の戸籍とフィリピンの民事登録が、別々の事実を記録している状態になります。

日本の書類では独身。フィリピンの書類では既婚。どちらも間違いではなく、両方が正しい。

書類の上では、こう現れます

フィリピン統計庁(PSA)に婚姻記録を照会したとき、記録が見つからなければ CENOMAR(婚姻記録がないことの証明)が発行されます。記録が見つかった場合は、代わりに AOM(Advisory on Marriages) が発行されます。

ここでつまずく方が多いところ

AOMは、婚姻が無効とされていても、死別でも、海外で解消していても発行されます。「いま既婚である」という意味ではなく、「記録が残っている」という意味です。

ただし手続きの上では効果は同じで、CENOMARが出ない以上、在日フィリピン大使館は婚姻要件具備証明書(LCCM)を発行できません。LCCMがないと、日本の市区町村では通常どおりの受理ができず、法務局の判断を仰ぐ「受理伺い」になります。受理されることもありますが、それで解決したわけではありません(後述)。

元に戻すには、フィリピンの裁判所の判断が要る

必要なのは、外国離婚判決の承認裁判(Judicial Recognition of Foreign Divorce、略してJRD)です。フィリピンの地方裁判所(Regional Trial Court)に民事訴訟として提起し、「日本で成立した離婚を、フィリピンでも有効と認めてください」と求めます。

根拠はフィリピン家族法26条2項です。フィリピン人と外国人の婚姻について、外国で有効に離婚が成立した場合、フィリピン人配偶者も再婚できる、と定めています。

2018年に、大きな変化がありました

かつては「外国人配偶者の側が離婚を申し立てた場合でなければ26条2項は使えない」と解釈されていました。つまりフィリピン人の側から離婚を切り出した場合、再婚の道が閉ざされていたのです。

これを覆したのが Republic v. Manalo(G.R. No. 221029、2018年4月24日)です。フィリピン人女性のマレリン・タネド・マナロさんが日本人男性と結婚し、日本の裁判所で離婚を得たケースでした。最高裁は、フィリピン人の側が離婚を申し立てた場合でも26条2項は適用されると判断し、法をフィリピン人に不利に解釈することはできない、と述べています。

安心してよい点

ご自身から離婚を切り出した場合でも、この手続きは使えます。「自分から離婚したから無理だ」と諦めてしまっている方が、いまだにいらっしゃいます。2018年以降、そこは変わっています。

手続きの流れ

  1. フィリピンの弁護士に依頼する

    JRDはフィリピン国内の裁判手続きです。現地の弁護士に依頼するのが前提になります。日本にいながら進めることはできますが、代理人は必要です。

  2. 日本側の書類を揃え、英訳してアポスティーユを取る

    離婚の事実を示す日本の書類を、英訳したうえで日本の外務省のアポスティーユ認証を受けます。在日フィリピン大使館は「日本で発行または取得したすべての書類は、日本の外務省によるアポスティーユを受けなければならない」と明記しています。

  3. 地方裁判所(RTC)に提訴する

    婚姻が登録された地、または申立人の居住地を管轄する裁判所に、民事訴訟として提起します。

  4. 判決を受け、確定させる

    判決が出たら、判決確定証明書(Certificate of Finality)を取得します。

  5. 民事登録に反映させる

    判決を地方民事登録事務所に登録し、婚姻が登録されている登録官に提出します。東京で婚姻を登録した場合は、大使館での記注を経てマニラの民事登録総局に送られます。

  6. 新しいCENOMARを取得する

    反映が完了すると、離婚が登録された状態のCENOMAR(CENOMAR Form No.5 registered foreign divorce)が取得できるようになります。ここでようやくLCCMの申請に進めます。

動き始めるのが1年遅れると、再婚できる時期がそのまま1年遅れます。

これが、この手続きで最も強調しておきたい点です。書類を集める作業と違って、裁判は待っている時間そのものが長い。「結婚が具体的になってから考えよう」では間に合いません。再婚の可能性が見えた時点で着手するのが、結果的に一番早く済みます。

日本では受理されることがある。でも、それで終わりではありません

実務では、承認裁判が終わっていなくても、日本の役所で再婚の届出が受理されるケースがあります。婚姻要件具備証明書が出せない場合、市区町村は「受理伺い」として法務局の判断を仰ぎます。日本での離婚から一定の期間が経過しているなど条件が整えば、受理されることがあるのです。そして受理された婚姻は、日本では有効な婚姻です。

ここで安心してしまう方が多いのですが、話はまだ終わっていません。

フィリピン側に登録できません

2012年12月1日より、在京フィリピン大使館は、フィリピンへの婚姻の届出(Report of Marriage)に際し、離婚歴のある申請者に対して、注釈付きの結婚証明書と、フィリピンの裁判所が発行した外国離婚承認の判決文の提出を求めています。

つまり承認裁判を経ていないと、日本では夫婦、フィリピンでは他人——しかも前の婚姻が続いたまま、という状態になります。これを跛行婚(はこうこん)といいます。

あとで効いてくる場面

  • お子さんの登録。フィリピン側で婚姻が存在しないため、出生の届出で説明が必要になります。
  • 相続や財産。フィリピンに不動産や権利がある場合、配偶者として扱われません。
  • 姓と身分証。フィリピンのパスポートや証明書の姓は、前の婚姻を前提としたままになります。
  • 重婚の問題。フィリピンでは重婚が犯罪とされており、承認を経ずに再婚した場合のリスクを指摘する専門家がいます。帰国のご予定がある方は、必ずフィリピンの弁護士にご確認ください。

承認裁判は「結婚するために要る」のではなく、「あとで困らないために要る」ものです。

離婚の方式を選べる段階にいる方へ

これから日本で離婚される場合、方式によって後の承認裁判の難しさが変わることがあります。協議離婚には裁判所の判決書がありません。フィリピンの裁判所に「日本で有効に離婚が成立した」ことを立証する段になって、判決書がないぶん手間がかかる場合があります。

将来フィリピン側での再婚登録を考えている方は、離婚の方式を決める前にフィリピンの弁護士に相談する価値があります。あとから方式は変えられません。

You are divorced in Japan. The Philippines still has you married.

Your divorce went through at the Japanese city office. The Japanese family register says you are single. Yet the paper that arrives from the PSA still shows a marriage. This is not a mistake, and it is not rare — it is simply how the two systems work. Here is why it happens, what it means if a Japanese office accepts your remarriage anyway, and what it takes to put it right.

What is actually happening

The Philippines is the only country in the world, apart from Vatican City, where divorce is not permitted by law. A bill to legalise it passed the House in May 2024, but as of August 2026 it has not cleared the Senate.

So when a divorce is completed at a Japanese city office, nothing changes on the Philippine side. The Japanese register and the Philippine civil registry end up recording two different facts about the same person.

Single on the Japanese paper. Married on the Philippine one. Neither is wrong — both are correct.

How it shows up in your documents

When the Philippine Statistics Authority searches its records, it issues a CENOMAR if it finds no marriage. If it finds one, it issues an Advisory on Marriages instead.

Where people get stuck

An Advisory is issued even if the marriage was annulled, ended by your spouse's death, or dissolved abroad. It does not mean you are married now. It means a record exists.

Practically, the effect is the same: without a CENOMAR, the Philippine Embassy in Japan cannot issue the LCCM you need. Without an LCCM a Japanese city office cannot process the registration in the ordinary way, and refers it to the Legal Affairs Bureau. It may still be accepted — but that does not mean the problem is solved (see below).

Putting it right needs a Philippine court

What you need is a Judicial Recognition of Foreign Divorce (JRD) — a civil action filed with a Regional Trial Court in the Philippines, asking the court to recognise that the divorce obtained in Japan is valid.

The basis is Article 26, paragraph 2 of the Family Code: where a marriage between a Filipino and a foreign national is validly dissolved abroad, the Filipino spouse also becomes capacitated to remarry.

2018 changed something important

It used to be read as applying only where the foreign spouse obtained the divorce. If the Filipino spouse had been the one to file, the door to remarrying stayed shut.

That reading was overturned in Republic v. Manalo (G.R. No. 221029, 24 April 2018). Marelyn Tanedo Manalo, a Filipina, had married a Japanese national and obtained a divorce from a Japanese court. The Supreme Court held that Article 26(2) applies even where it was the Filipino spouse who filed, saying the law cannot be read in a way that discriminates against Filipinos.

If you filed for the divorce yourself

This route is still open to you. People still give up on remarrying because they believe filing for the divorce themselves disqualifies them. Since 2018, it does not.

How the process runs

  1. Engage a lawyer in the Philippines

    A JRD is a Philippine court case. You will need counsel there. You can run the whole thing from Japan, but you cannot run it without a representative.

  2. Gather the Japanese documents, translate them, and get them apostilled

    The Japanese documents proving the divorce must be translated into English and then apostilled by Japan's Ministry of Foreign Affairs. The Philippine Embassy in Japan states plainly that every document issued or obtained in Japan must carry that apostille.

  3. File with the Regional Trial Court

    Filed as a civil action, with the court that has jurisdiction over where the marriage was registered or where the petitioner resides.

  4. Obtain the decision and let it become final

    Once the court rules, obtain the Certificate of Finality.

  5. Have it registered

    The decision is registered with the local civil registry office and submitted to the registrar holding the marriage record. For marriages registered in Tokyo, it is annotated at the Embassy and forwarded to the Office of the Civil Registrar General in Manila.

  6. Request a new CENOMAR

    Once everything is reflected, you can obtain a CENOMAR Form No.5 registered foreign divorce. Only then can you apply for the LCCM.

Start a year late, and you remarry a year later. It is that direct.

This is the single most important thing on this page. Unlike collecting documents, a court case is mostly waiting. Deciding to look into it once a wedding is already being planned is too late. Starting when remarriage first becomes a possibility is, in the end, the fastest route.

Japan may accept the marriage. That is not the end of it.

In practice, a Japanese city office will sometimes accept a remarriage even where no recognition case has been completed. Where the LCCM cannot be produced, the office refers the matter to the Legal Affairs Bureau as a juri-ukagai. If enough time has passed since the Japanese divorce and the other conditions are met, it can be accepted — and a marriage accepted this way is a valid marriage in Japan.

Many people relax at this point. The story is not over.

You cannot register it in the Philippines

Since 1 December 2012, the Philippine Embassy in Tokyo has required applicants with a divorce history to submit an annotated marriage certificate and the decision of a Philippine court recognising the foreign divorce when filing a Report of Marriage.

Without the recognition case, you end up married in Japan and unmarried in the Philippines — with your previous marriage still on record there. This is what is called a limping marriage.

Where it catches up with you

  • Registering your children. Since no marriage exists on the Philippine side, the birth report will need explaining.
  • Inheritance and property. If you hold property or rights in the Philippines, your new spouse is not treated as your spouse.
  • Your name and your ID. Your Philippine passport and certificates continue to reflect the earlier marriage.
  • Bigamy. Bigamy is a criminal offence in the Philippines, and practitioners warn about the exposure where someone remarries without recognition. If you plan to return, take this to a Philippine lawyer.

The recognition case is not what lets you marry. It is what keeps the marriage from causing trouble later.

If you have not divorced yet

If a Japanese divorce is still ahead of you, the form it takes can affect how hard the recognition case becomes. A divorce by mutual agreement produces no court decision. When the time comes to prove to a Philippine court that the divorce was validly obtained, the absence of a judgment can make that harder.

If you expect to register a remarriage in the Philippines one day, it is worth speaking to a Philippine lawyer before you settle on the form of the divorce. You cannot change it afterwards.

  • Certificate of acceptance of the divorce notification, or the divorce judgment with its certificate of finality
  • Anything else your counsel or the court asks for

On certified translation

The order matters: translate into English first, then obtain the apostille. Where the translation's formatting or terminology is inconsistent, it can be sent back at the authentication stage or by the court. そもそもCENOMARとは

正式名称は Certificate of No Marriage Record。フィリピン統計庁(PSA)が管理している婚姻の登録記録を照会して、「あなたの名前で登録された婚姻が見当たりません」と証明する書類です。日本でいう独身証明書にあたります。

結婚手続きでは、この書類がないと在日フィリピン大使館・領事館で LCCM(婚姻要件具備証明書)を申請できません。LCCMがなければ、日本の市区町村での手続きも通常どおりには進みません。つまりすべての入口にあたる書類です。

先に確認してほしいこと

PSAに婚姻の記録がある場合、CENOMARは発行されません。代わりに AOM(Advisory on Marriages)という、婚姻記録の一覧が出ます。

方法1|オンラインで日本に届けてもらう

PSAの公式オンライン窓口である PSA Serbilis は、フィリピン国外への配送に対応しています。日本の住所を指定すれば、そのまま届きます。

  1. 申請に必要な情報を揃える

    フルネーム、生年月日、出生地、父母の氏名(母親は旧姓)、使用目的。この5つが揃っていないと申し込めません。

  2. 使用目的を「結婚のため」にする

    Purpose の欄で For Marriage を選びます。目的によって発行される書式が変わることがあるため、ここは正確に。

  3. 支払う

    クレジットカード、デビットカードのほか、GCash、Maya、ShopeePay などの電子マネーが使えます。フィリピン国内であれば Bayad Center、7-Eleven、BDO、UnionBank の窓口でも支払えます。

  4. 受け取る

    ご自身で受け取れない場合は、申し込みの際に「代理人に受け取ってもらう」を選び、オンラインの委任(Letter of Authorization)を入力しておきます。

  5. アポスティーユ認証を受ける

    配偶者ビザや婚姻手続きで使う場合、フィリピン外務省(DFA)のアポスティーユ認証が別途必要です。取得後にもうひと手間かかることを見込んでおいてください。

方法2|ご家族に代わりに取ってもらう

CENOMARは本人以外でも請求できます。配偶者、親、子、兄弟姉妹であれば、続柄がわかる形で請求できるのが一般的です。それ以外の方に頼む場合は、委任状が必要になります。

委任状に必要なもの

  • 本人が署名した委任状(誰に、何の書類の請求を委任するかを明記)
  • 本人の有効な身分証(原本とコピー)
  • 代理人の有効な身分証(原本とコピー)

見落とされがちな条件

身分証の署名と、委任状の署名が一致している必要があります。ここが揃わずに窓口で止まるケースがあります。署名は普段の書き癖ではなく、身分証に登録されている形に合わせてください。

なお、通常の証明書の受け取りであれば、委任状に領事認証を受ける必要はありません

委任状の書き方(英文・参考)

決まった様式はありません。以下の要素が入っていれば足ります。ご自身の言葉で作成してください。

早く取ればいいというものではありません。有効期限のある書類です。

これはCENOMARに限らず、この手続き全般に言えることです。裁判や認証など「時間がかかるもの」は最初に着手し、有効期限のある証明書は後から取る。この順番を逆にすると、取り直しになります。

取得したあと

CENOMARが手に入ったら、DFAのアポスティーユ認証を受け、在日フィリピン大使館・領事館で LCCM(婚姻要件具備証明書)を申請します。LCCMの申請は予約して窓口に行く方法のほかに、郵送でも行えます。ただし、どちらかが窓口に出頭できない場合は、申請書に日本の公証人の認証を受ける必要があります。栃木県は東京の大使館の管轄です(名古屋・大阪の総領事館ではありません)。順番と必要書類の全体像は フィリピン人との結婚手続き|栃木で必要な書類と順番 にまとめています。

日本語訳について

CENOMARを日本の市区町村や出入国在留管理庁に提出する際は、日本語の訳文が必要です。翻訳者の氏名を記載した訳文を添える形が一般的で、原本と訳文をセットで提出します。当サイトを運営する株式会社Solfでは、PSA発行書類の認証翻訳をお受けしています。ご自身で用意される場合は、日付・地名・人名の綴りを原本と完全に一致させてください。ここがずれると差し戻しの原因になります。

Getting your CENOMAR without leaving Japan

The CENOMAR is the first document you will need in order to marry in Japan. It is issued only in the Philippines — but you do not have to fly home for it. It can be delivered to your address here, or a family member can collect it for you there. Which route suits you depends on your situation.

What a CENOMAR actually is

Certificate of No Marriage Record. The Philippine Statistics Authority searches its civil registry and certifies that no marriage is recorded under your name.

Without it, the Philippine Embassy or Consulate in Japan cannot issue your LCCM (Legal Capacity to Contract Marriage). And without an LCCM, a Japanese city office cannot process your marriage registration in the ordinary way. Everything else starts here.

Check this first

If the PSA does hold a marriage record for you, no CENOMAR will be issued. You will receive an Advisory on Marriages instead — a list of the marriages on record.

If you have been married before, widowed, or divorced, sort that out before following the steps here. In particular, if you divorced in Japan, the Philippine record still shows you as married. See You are divorced in Japan. The Philippines still has you married.

Route 1 — order online, delivered to Japan

PSA Serbilis is the PSA's own online facility, and it ships outside the Philippines. Enter your address in Japan and it arrives here.

  1. Have your details ready

    Full name, date of birth, place of birth, your parents' names (your mother's maiden name), and the purpose. Without all five you cannot complete the order.

  2. Set the purpose to marriage

    Choose For Marriage. The form issued can differ by purpose, so get this right.

  3. Pay

    Credit and debit cards, plus GCash, Maya and ShopeePay. Inside the Philippines you can also pay at Bayad Center, 7-Eleven, BDO and UnionBank.

  4. Receive it

    If you cannot receive the delivery yourself, choose the option to assign someone and complete the online Letter of Authorization when you order.

  5. Get it apostilled

    To use it for a marriage or a spouse visa you also need an apostille from the Philippine DFA. Build that extra step into your timing.

Route 2 — have a relative request it

Someone else can request your CENOMAR. A spouse, parent, child or sibling can generally do so where the relationship is clear. Anyone else needs an authorisation letter.

What the authorisation needs

  • A letter signed by you, naming who is authorised and which document they may request
  • Your valid government ID — original and photocopy
  • Your representative's valid ID — original and photocopy

The condition people miss

Your signature on the letter has to match the signature on your ID. Requests get turned away at the counter over this. Sign the way your ID has it, not the way you normally sign.

For ordinary collection, the letter does not need consular authentication.

There is no prescribed form. As long as these elements are present, it is sufficient. Write it in your own words.

Earlier is not better. This document has a shelf life.

That holds across the whole process, not just this document. Start the slow things — court cases, authentications — first, and collect the time-limited certificates last. Do it the other way round and you will be paying for them twice.

After you have it

Get the DFA apostille, then apply for your LCCM at the Philippine Embassy or Consulate in Japan. You can file either in person by appointment or by post — but if either of you cannot appear, the forms must be notarised by a Japanese notary public. If you live in Tochigi, your office is the Embassy in Tokyo, not the consulates in Nagoya or Osaka. On the Japanese translation

To submit a CENOMAR to a Japanese city office or to Immigration, you need a Japanese translation. The usual form is a translation bearing the translator's name, submitted together with the original. If you prepare it yourself, make the dates, place names and spellings match the original exactly — mismatches are the usual reason things get sent back.
